These Terms and Conditions are the Grand Draw Rules. By entering the Grand Draw, entrants agree to be bound by these rules. |

This Grand Draw is being promoted by and on behalf of Helen Rollason Heal Cancer Charity (HRHCC). The promoter of the draw is Sue Hayden, Helen Rollason Heal Cancer Charity, Woodside, Broomfield Hospital, Court Road, Chelmsford, Essex CM1 7ET. Registered in England with company number 3144906, registered charity number: 1052861 (the Promoter). |

For the purpose of the Gambling Act 2005, this draw is defined as a "Society Lottery". HRHCC is licensed as a small society under the Act for the purpose of this lottery. |

This Grand Draw is open to residents of the UK only, aged 18 years or over, but is not open to employees of HRHCC or their families. |

All tickets shall be priced at £1. |

All Grand Draw entry sales are final and no refunds shall be made at any time. All entrants acknowledge that their payment of £1 per ticket to enter the Grand Draw does not guarantee that they will win any prize. |

The closing date for entries is 1 December 2008. The Grand Draw will be made by Professor Neville Davidson and will take place at 2pm on 15 December 2008 at Rochelle House, Lawn Lane, Springfield, Chelmsford CM1 7JT. Winners will be notified by telephone within 7 days of this date. Further confirmation will be provided in writing. |

HRHCC accepts no responsibility for lost, mislaid, delayed or damaged tickets. The winners will be chosen at random by HRHCC. The Grand Draw, once made, is final and no correspondence will be entered into. Prizes are non-transferable and there is no cash alternative. |

HRHCC reserves the right in exceptional and unforeseen circumstances to substitute any of the non cash prizes acquired for the Grand Draw for a similar prize at HRHCC's absolute discretion. |

Full payment for each ticket must be received either in the form of cash or cleared funds before the ticket can be entered into the Grand Draw. Only tickets for which full payment has been received either in the form of cash or cleared funds is eligible to win a prize. |

All entrants are solely responsible for providing HRHCC with their accurate and up-to-date contact details and HRHCC will be in no way liable for any failure or inability to contact any entrant due to any errors, omissions or inaccuracies in the contact details that the entrant has provided. In the event that an entrant changes their contact details, they will be solely responsible for advising HRHCC. |

Any prize winner will be required to send a certified copy of their passport to the Promoter to confirm his or her identity and age before any prize will be awarded. Following receipt and verification of the details above, the Promoter will contact the prize winners in order to make arrangements for delivery of the applicable prize. The Promoter will deliver only to the prize winners and to the address stated in the Grand Draw entry. |

By accepting the prize, the winner agrees to take part in promotional activity and HRHCC reserves the right to use the name and home county of the winner, their photograph and audio and/or visual recordings of them in any publicity unless prior notification has been received. |

HRHCC makes no representations, conditions or warranties as to the quality or suitability of any of the goods or services offered as prizes. HRHCC shall not be liable to you or any other person for any loss suffered or caused including (without limitation) consequential, special and indirect loss by reason of any act or omission by HRHCC or its servants or agents in connection with the arrangement for supply, or the supply of, any goods or services by any person to a winner and, where applicable, to any family, persons or individuals accompanying a winner.
In particular, HRHCC shall not be liable for any loss or damage suffered or arising from:-
- any delays or failures in the postal service or other delivery methods used by HRHCC, any prize supplier or the winner from time to time;
- delays or failures in any software or other systems used by HRHCC or any prize supplier for the administration of the lottery;
- any delays or failures in the banking system used by HRHCC;
- any failure to enter a chance into the draw; or
- any event beyond the reasonable control of HRHCC.
This provision shall not apply to exclude or limit HRHCC's liability for death or personal injury to any person caused by HRHCC's negligence. |

HRHCC is committed to protecting the member's privacy. Data that is collected from the member is used lawfully in accordance with the Data Protection Act 1998 and is used solely for the purpose of processing lottery chances, subsequent entry into the Grand Draw, and informing winners that they have won a prize. Any member has the right to access the information held about them. To obtain this information, please contact the HRHCC in writing.
HRHCC will not sell, rent or grant access of any personal data to any third party without express prior permission. |

In the event of any dispute regarding the rules, the decision of HRHCC shall be final and no correspondence or discussion shall be entered into. |

HRHCC reserves the right to amend these rules at any time. If HRHCC does this, it will publish the amended rules. |

A copy of these rules may be obtained by sending a sending a stamped addressed envelope to HRHCC at the address above. |

The Laws of England and Wales shall govern the interpretation and/or enforcement of these Terms and Conditions and HRHCC and all Grand Draw entrants hereby submit to the exclusive jurisdiction of the English courts. |

1st prize: Holiday to Gran Canaria, donated by Direct Connection (tel: 0845 123 2523, www.directconnection.co.uk). The prize entitles the winner to a seven night stay at the Las Rosas development in Playa del Ingles in a 2 bedroom apartment for 2 guests, to be taken from the 11th May 2009.
The prize includes return flights from Gatwick for two people only. Please contact Direct Connection for further details regarding the flight times. The holiday does not include transfers.
The prize does not include travel insurance (which you should take out), spending money, meals or transport apart from those stated.
It is the responsibility of the prize winner to ensure they have a valid passport.
Events may occur that render the prize itself or the awarding of the prize impossible due to reasons beyond the control of HRHCC or its prize supplier Direct Connection and accordingly HRHCC may (with its prize supplier Direct Connection) at its absolute discretion vary or amend the promotion and the entrant agrees that no liability shall attach to HRHCC or to Direct Connection as a result thereof. |

2nd prize: Balloon flight for one, donated by Eastern Balloon Rides (tel: 01376 585544, www.easternballoons.com)
The prize entitles one person to a Hot Air Balloon Flight, available on any weekdays (except bank holidays) from 31 December 2008 to 30 September 2009.

HRHCC does not accept any responsibility in regard to the existence or extent of this guarantee. |

4th prize: £30 Prezzo vouchers.
The voucher can be used any of the Prezzo Restaurants and is only valid for food and drink and cannot be exchanged for cash. |
